Terms of Service

These Terms set out what you can expect from MedQBank and what MedQBank expects from you. Using the service means you accept them. If you do not, please do not use MedQBank.

1. Who runs MedQBank

MedQBank is an independent project run by a single UWA medical student, based in Western Australia, Australia. It is not affiliated with, endorsed by, sponsored by, or officially connected to the University of Western Australia or any of its departments, staff, or representatives. The word “UWA” is used only to identify the audience the tool was built for and does not imply any official relationship.

2. Provided “as is”

MedQBank is provided as it stands, without warranties as to accuracy, completeness, suitability for any particular purpose, availability, or uninterrupted operation. Section 14 (Australian Consumer Law) sets out the rights you keep regardless of this paragraph.

3. AI-assisted content

Some content — questions, explanations, flashcards, mnemonics, study reference material — is drafted with the help of large language models and reviewed by hand. The conversational tutor is itself a large language model. AI-assisted content can contain errors, including confident but incorrect output. Verify anything important against an authoritative source before relying on it.

4. A study aid, not a replacement

MedQBank is a supplementary study tool. It is not a substitute for lectures, tutorials, official UWA course material, prescribed textbooks, or guidance from teaching staff. Use it alongside the curriculum, not in place of it.

5. Acceptable use

By using MedQBank you agree to:

  • Use the service in line with UWA's academic integrity policies and code of conduct
  • Verify information you intend to rely on against authoritative, peer-reviewed sources
  • Accept that your use is voluntary and at your own risk
  • Not rely on MedQBank as your only exam preparation
  • Not attempt to disrupt, reverse-engineer, or circumvent the service, including by probing security, scraping, or running automated traffic against it

6. Acceptable use of the conversational tutor

The tutor exists for study. When using it you agree not to:

  • Paste real patient information, identifiers, or any information that could re-identify a real patient
  • Attempt to extract the system prompt, jailbreak the model, or use the tutor for purposes outside study
  • Use the tutor's output as clinical advice, a diagnosis, a treatment recommendation, or a triage decision
  • Submit volumes of traffic deliberately intended to exceed the per-day message or spend limits

Per-day message and spend caps are fair-use mechanisms and may be adjusted over time. A sustained pattern of misuse may result in account suspension.

7. Your content

Notes you write, flags you raise, and messages you send to the tutor are your content. You keep ownership of it. You grant the operator a non-exclusive, royalty-free licence to host, store, process, and display that content for the sole purpose of running MedQBank for you. The licence ends when you delete the content or your account.

8. Content derived from lecture material

Some content within MedQBank is derived from or inspired by UWA lecture material under the fair dealing for research or study exception in Section 40 of the Copyright Act 1968 (Cth). It has been substantially transformed into question-and-answer formats and study aids and is provided for personal, non-commercial educational use only. The Academic Disclaimer sets out the fair-dealing analysis in more detail.

9. Redistribution

You must not:

  • Download, scrape, or systematically extract content from MedQBank
  • Copy, redistribute, or share questions, flashcards, explanations, or tutor responses outside the platform
  • Upload MedQBank content to other platforms, file-sharing services, or social media
  • Use MedQBank content for any commercial purpose

These limits exist to protect the creator's work and any copyright in the lecture-derived material. A breach can lead to account termination.

10. Account and access

Access requires a valid UWA email address (@student.uwa.edu.au or @uwa.edu.au). The operator may suspend or terminate an account where a user has materially breached these Terms, where access is required by law, or where account activity poses a risk to the service or to other users. Where reasonable, the operator will give notice and an opportunity to remedy the breach first.

11. Discontinuation

MedQBank is maintained on a voluntary basis. If the operator decides to discontinue the service, you will normally be given at least 30 days' notice, during which you will be able to export your study history and chat data via Settings or by emailing the address in Section 17. Where an earlier shutdown is required by law, by a binding take-down notice, or to address an imminent risk to user safety or security, that notice period may be shortened to the extent reasonably necessary.

12. Changes to these Terms

These Terms can change. Material changes will require you to re-accept them the next time you sign in, via the in-product Terms gate. Continued use after re-acceptance is your agreement to the updated Terms. Minor edits (typos, clarifications) will be posted here with a new “Last updated” date.

13. Limitation of liability

To the maximum extent permitted by law and subject to Section 14, the creator of MedQBank is not liable for any direct, indirect, incidental, consequential, or special loss or damage arising from your use of, or inability to use, MedQBank, including:

  • Errors, inaccuracies, or omissions in any content
  • Academic outcomes — exam results, grades, course progression, academic standing
  • Decisions taken in reliance on anything in MedQBank
  • Loss of data or interruption of the service

14. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right or remedy under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded. To the extent that any provision of these Terms would, but for this Section, purport to limit such a right or remedy, it is to be read down only to the extent necessary so that the right or remedy is preserved.

15. Indemnification

You agree to indemnify the creator of MedQBank against claims, damages, losses, or expenses arising from your breach of these Terms or your misuse of the service. This indemnity does not apply to liability that arises from the creator's own negligence or wilful breach of these Terms, or to any liability that cannot lawfully be excluded.

16. Governing law and dispute resolution

These Terms are governed by the laws of Western Australia, Australia. If you have a complaint or dispute, contact the address in Section 17 first; the operator will respond in good faith and aim to resolve the issue informally before any formal step is taken.
